Within the framework of the State of Emergency caused as a result of the appearance and spread of the Coronavirus “Covid-19“, an almost absolute paralysis was generated throughout the construction sector in Peru. It is within this conjunctural framework that on September 4, 2020, Supreme Decree No. 250-2020-EF was published, which modifies the Regulation of Law No. 30225 - Law on State Contracting, providing for the mandatory incorporation of the Dispute Resolution Board in all major work contracts that exceed S / 20'000,000.00. This research project, which is supported as a thesis to opt for the title of lawyer, has as an additional purpose to know the efficiency and impact on the continuity of public works and infrastructure contracts from the regulatory change within the framework of the Peruvian State Contracting Law. In order to answer this question, the methodology used is the Cost Benefit Analysis (“CBA“) which, through a series of steps, aims to determine the efficiency of a regulatory change in relation to the possible advantages and disadvantages that it could generate at all levels within a territorial framework, in this case, Peru. In a complementary way, this thesis is based on a series of finite interviews with various lawyers, engineers and experts with active experience in state procurement; complemented by international statistical analysis. The findings collected both from the CBA methodology, the interviews conducted, as well as the available statistics allow us to conclude that the implementation of the Disputes Boards represent a very attractive economic measure, with numerous benefits and considerable acceptance by the parties of state contracting. However, this figure, due to its versatility, is constantly changing; Therefore, a greater dissemination of the figure is expected to expand its coverage to contracts of different nature.
