In recent years, the presence of non-tariff measures issued by the United States has been perceived, which, despite having a legitimate justification, have created an obstruction and unnecessary barriers to international trade. Consequently, this has directly impacted Peruvian exports of evaporated milk destined for the US market, during the period from 2009 to 2019. This event supports the basis of the present investigation, which will be developed from a mixed-type methodology and validated under the commercial gravitation model. With this study, it will be possible to determine the influence of technical obstacles and sanitary measures on Peruvian evaporated milk exports. Having as one of the most important milestones the Import Alert 99 39 issued by the FDA, because it exposed the existing problem between the relationship between Peruvian technical standards and the lack of harmony with international regulations. The application of unnecessary requirements and obstacles to trade, the lack of exhaustive quality control, the discrepancy between Peruvian and US regulations, and the limited presence of government entities, such as SENASA, INACAL, and MINAGRI, gave rise to various acts of faults that would result in a negative influence on exports of Peruvian evaporated milk to the United States.
