Resumen: La presente tesis de investigación se trabajó bajo el titulo de “Sustitución del congresista
designado Ministro de Estado por el congresista accesitario”, en ese sentido, se señaló
como enunciado del problema principal, el siguiente, “Cuáles son los fundamentos
jurídicos que sustentarían la suspensión de las funciones congresales del parlamentario
designado ministro y su sustitución -mientras ejerce este cargo- por el congresista
accesitario?”, asi mismo, se estabeció como objetivo central o general del trabajo el
siguiente: “determinar cuáles son los fundamentos jurídicos que sustentarían la
suspensión de las funciones congresales del parlamentario designado ministro y su
sustitución -mientras ejerce este cargo- por el congresista accesitario”, posteriormente
se establceió la hipotesis de la siguiente forma: “Los fundamentos jurídicos que
sustentarían la suspensión de las funciones congresales del parlamentario designado
ministro y su sustitución -mientras ejerce este cargo- por el congresista accesitario son:
el principio de división de poderes, la deslegitimación de la voluntad popular y la
necesidad de ejercer control de los actos del ejecutivo”, posteriormete se hzo uso de los
métodos jurídicos de investigación y luego de ello se pudo contrastar la hiótesis,
plasmando los resultados de manera categórica; lo que fue recogido en las conclusiones.
El trabajo se desarrolló como una investigación descriptiva – dogmática, no utilizando
por tal motivo población y muestra
The present research thesis was worked under the title of ““Replacement of the congressman appointed Minister of State by the accessory congressman““, in that sense, the following was pointed out as the main problem statement, ““What are the legal grounds that would support the suspension of the congressional functions of the parliamentarian appointed minister and his substitution -while he holds this position by the assistant congressman?““ Likewise, the following was established as the central or general objective of the work: ““determine what are the legal grounds that would support the suspension of the congressional functions of the parliamentarian appointed minister and his substitution -while holding this position- by the congressional assistant““, later the hypothesis was established as follows: ““The legal grounds that would support the suspension of the congressional functions of the parliamentarian designated minister and his replacement -while holding this position- by the co accessory incomer are: the principle of division of powers, the delegitimization of the popular will and the need to exercise control over the acts of the executive”, later legal research methods were used and after that the hypothesis could be contrasted, capturing the results categorically; what was collected in the conclusions. The work was developed as a descriptive - dogmatic research, not using population and sample for this reason
