The present Thesis entitled “The applicable criteria for the assessment or dismissal of the testimonial evidence of witnesses with reservation code in organized crime proceedings in the Judicial District of La Libertad, Period 2014 - 2018“, whose main objective was to determine which are the criteria adopted by the magistrates at the time of the individual assessment of the testimonial evidence of witnesses with reserved identity in organized crime proceedings. In the development of the thesis a non-experimental research design was used, of a basic type, with a qualitative approach at a descriptive level; while the methods used for the analysis of the data are the scientific, analytical, synthetic, inductive, deductive, historical, comparative, hermeneutic, exegetic and systematic methods. Likewise, we applied the interview and documentary analysis techniques for data collection, with their respective instruments: the interview guide was applied to the sample formed by 8 specialists in criminal matters and the documentary analysis guide to 8 documentary sources. As a general result, it was determined that the criminal legal system establishes general criteria for an adequate evaluation of the testimonial evidence of those witnesses who have a reservation code, that is, specific criteria for the evaluation of this type of evidence in criminal proceedings are not established in an exhaustive manner, which has caused the doctrine and specialized jurisprudence on the subject to develop more specific criteria that serve as legal tools for judges when evaluating testimonial evidence. Finally, as an overall conclusion it was established that the incorporation of the legal figure of the witness with a reservation code in Peru is novel and is born as a criminal policy to face the increase of serious illicit acts, for its legitimate admission this type of evidence is required to take into account the requirements set by the criminal system and, for the evaluation of the testimonial evidence of witnesses with a reservation code, it is necessary to apply the general criteria established in the Code of Criminal Procedure and the specific criteria in the doctrine and jurisprudence, in order to make the rights of the witness compatible with the constitutional procedural guarantees of the accused.
