This thesis has been titled “The rejection of the claim for reasons other than those indicated by law and the violation of the right of access to jurisdiction”; and, it starts from the following question: “Does the rejection of the claim, for reasons of inadmissibility or inadmissibility other than those indicated by law, violate the right of access to jurisdiction?” Its main objective is: “To demonstrate that the rejection of the claim for reasons of inadmissibility or inadmissibility other than those indicated by law violates the right of access to jurisdiction”; and, as specific objectives: 1. Study the function that the qualification of the claim plays within the Peruvian civil process.2. Demonstrate that it is not possible for the judge to analogically create grounds for inadmissibility and inadmissibility not provided for in the law. 3. Analyze the right of access to jurisdiction as part of the principle of effective Jurisdictional Protection. After having applied the research methods, techniques and instruments described in the body of our work, we have reached the following main conclusion: “The rejection of the claim, for reasons of admissibility or inadmissibility other than those indicated by the law, violates the right of access to jurisdiction, since when this happens, these grounds, artificially created by the judge evaluating the claim, deny the defendant the possibility of discussing his claim within a process with all the guarantees of due process
