Reconocimiento y regulación de los bienes digitales en la sucesión hereditaria en el sistema jurídico peruano, 2023

Abstract

En la presente investigación, se tiene como objetivo exponer y sustentar una propuesta para la regulación y reconocimiento de los bienes digitales en el derecho sucesorio del sistema jurídico peruano. Para ello, el investigador realizó una descripción de la realidad de la edad contemporánea en el uso de su identidad digital y sobre la creciente creación y demanda de los elementos digitales. Así como también, se describió el estado actual del sistema jurídico peruano en materia de derecho sucesorio. Finalmente se sustentará cual es la necesidad de regular los bienes digitales para su transmisión vía sucesoria en el Perú. Inclusive, se sugerirá un proyecto legislativo con el fin de incorporar los bienes digitales en la masa hereditaria

In this research, the objective is to present and support a proposal for the regulation and recognition of digital assets in the inheritance law of the Peruvian legal system. To do this, the researcher made a description of the reality of the contemporary age in the use of their digital identity and the growing creation and demand for digital elements. As well as the current state of the Peruvian legal system in matters of inheritance law was described. Finally, the need to regulate digital assets for their transmission via succession in Peru will be supported. A legislative project will even be suggested to incorporate digital assets into the estate
