The thesis that today I put to the scrutiny of anyone who deems it convenient to review it has started from the premise of understanding that the formal nature of procedural law is not unnecessary; but, on the contrary, all that requirement of a certain procedural act has a reason for being. Hence, this investigation based on a rule that prescribes one of the requirements for admissibility of any claim, seeks to observe it from the prism of Constitutional law. In this sense, this thesis seeks to problematize the procedural rule contained in paragraph 2 of article 130 of the Civil Procedure Code; Well, according to our investigation, it has become unnecessary and outdated; and even exaggerated. A mandate contained as the one contained in the rule contemplated in the aforementioned article is in violation of the right of access to the jurisdiction; Well, in current times, it is a contradiction that the admissibility of a claim is subject to compliance with a requirement such as the one we have been mentioning; For this reason, this work ends with the proposal to repeal the rule that we have been pointing out.
