Inaplicación del enfoque de género y la verdad formal de la investigación preparatoria en ilícitos penales de violencia psicológica en agravio de la mujer

Abstract

El presente trabajo se realizó con la finalidad de poder establecer como es que afecta la inaplicación del enfoque de género por parte de los encargados de impartir justicia que laboran en el Ministerio Público del Distrito Fiscal de La Libertad se expresa en la verdad formal probatoria que persigue la investigación preparatoria en ilícitos penados que atenten contra la integridad psicológica de la mujer. La investigación realizada es básica, observacional bajo un diseño descriptivo propositivo, en donde la recopilación de datos cualitativos para el marco teórico se realizó a través de una revisión sistemática de jurisprudencias nacional, legislaciones, revistas y libros, y para los datos cuantitativos se empleó un cuestionario aplicado a profesionales. En referencia a los resultados del trabajo, se tiene que la incidencia de los ilícitos penales concernientes en los que la integridad psicológica de la mujer se ha visto vulnerada es alta, en el Distrito Fiscal de La Libertad en el año 2021, los problemas de pareja constituyen la causa principal; el 62.50% de las victimas presenta una valoración de riesgo moderado, el 62.50% de los certificados médicos legales no muestran lesiones externas; el 75% considera que trabajo Fiscal es insuficiente y no permite el éxito de proceso investigatorio lo que termina en archivo por no aplicar el enfoque de género. La conclusión principal es que la inaplicación del enfoque de género por los operadores jurídicos que trabajan en el Ministerio Público del Distrito Fiscal de La Libertad se expresa de manera negativa en la verdad formal probatoria que persigue la investigación preparatoria en los ilícitos penales de violencia psicológica hacía el sexo femenino al negar su acceso a la justicia, limitar su actividad probatoria y generar el archivo definitivo de los casos, por lo cual se recomienda la aplicación del enfoque de género. The present work was carried out with the purpose of being able to establish how the nonapplication of the gender approach affects the part of those in charge of imparting justice who work in the Public Ministry of the Fiscal District of La Libertad, expressed in the formal evidentiary truth that it pursues. the preparatory investigation in criminal offenses that threaten the psychological integrity of women. The research carried out is basic, observational under a pro-positive descriptive design, where the collection of qualitative data for the theoretical framework was carried out through a systematic review of national jurisprudence, legislation, magazines and books, and for quantitative data used a questionnaire applied to professionals. In reference to the results of the work, the incidence of criminal offenses in which the psychological integrity of women has been violated is high, in the Fiscal District of La Libertad in 2021, couple problems constitute the principal cause; 62.50% of the victims present a moderate risk assessment, 62.50% of the legal medical certificates do not show external injuries; 75% consider that the Prosecutor's work is insufficient and does not allow the success of the investigative process, which ends up in the file for not applying the gender approach. The main conclusion is that the non-application of the gender approach by the legal operators who work in the Public Ministry of the Fiscal District of La Libertad is expressed in a negative way in the formal evidentiary truth that the preparatory investigation pursues in criminal offenses of psychological violence against women. of the female sex by denying their access to justice, limiting their evidentiary activity and generating the definitive file of the cases, for which the application of the gender approach is recommended.
