The thesis that we have called ““THE EVALUATION OF THE PSYCHIATRIC EVIDENCE AND THE CONSTITUTIONAL GUARANTEE OF THE PRESUMPTION OF INNOCENCE““ aims to investigate how the evaluation of the expert psychiatric evidence affects the constitutional guarantee of the presumption of innocence. Regarding the objectives, we proposed, among others: to analyze the requirements for the evidentiary efficacy of the expert opinion, specifically, of psychiatry and psychology; establish differences between knowledge and psychological and psychiatric requirements that differentiate them in the scientific community as evidence of accusation for the prosecutor; understand the relationship between psychiatric experience and the proper application of criminal law and; Analyze the files of the victims with psychiatric and psychological expert evidence at the Institute of Legal Medicine in the period 2018-2019. In this sense, the problem that we have proposed is the following: HOW DOES THE EVIDENCE OF THE PSYCHIATRIC EXPERT EVIDENCE AFFECT THE CONSTITUTIONAL GUARANTEE OF THE PRESUMPTION OF INNOCENCE? Faced with this question, we formulate the following research hypothesis: ““The constitutional guarantee of the presumption of innocence is violated when a correct assessment of the psychiatric test is not applied, confusing it with the psychological test, which also triggers an inadequate application of the criminal law.““ 8 Finally, in application of the logical and legal methods, such as the historical - dogmatic, exegetical and analytical - synthetic, we have reached the following conclusion that there is no correct assessment between the psychiatric test and the psychological test, so it would be violating the constitutional guarantee of the presumption of innocence
