The objective of this research work entitled “Referential statement of the victim in criminal judicial processes obtained without the use of the Gesell Chamber“ was to determine how, at the level of criminal judicial processes, the referential statement of the victim can be assessed even when has been obtained without the use of the Gesell Chamber. The methodology used was descriptive, historical, legal, dogmatic, analytical, synthetic and systemic, the techniques were bibliographic analysis, filing, case study and survey. Finally, it concludes that an early test requires a hearing so that it can be incorporated into the criminal process, the referential statement of the victim obtained without the use of the Gesell Chamber must be submitted to a hearing to be considered an early test and in this way not may be dismissed, likewise, it is possible that the victim's statement will be valued even when it has been obtained without the use of the Gesell Chamber, this because the process would be expedited, and because as it is a single interview, there is a probability of that cannot be obtained at another time, likewise, several Gesell Chambers at the national level are inoperative, forcing the taking of a statement without this equipment.
