The Thesis that we have called ““Need to penalize unauthorized migrations in the cell phone service by means of a standard clause““, was aimed at determining the need to propose a standard clause that penalizes unauthorized migrations in the cell phone service, for which which used the most qualified doctrine, specialized interviews and statistical data from Osiptel. In this sense, the formulation of our Problem was the following: Is it necessary to propose a standard clause that penalizes unauthorized migrations in the cellular telephone service? The hypothesis that we proposed was the following: ““It is necessary to propose a standard clause that penalizes unauthorized migrations in the cellular telephone service in order to effectively reduce said unauthorized migrations by the operating companies.““ By virtue of the various methods of logical and legal application, it was possible to conclude that adhesion contracts, by their very nature, have contributed significantly to the business and economic dynamics in the telecommunications sector, with particular emphasis on the contracting of the cell phone; however, these benefits are not necessarily reflected in the execution or monitoring of the service offered, which is why various claims are made by users, including unauthorized migrations. Likewise, it was concluded that the inclusion of a standard clause that penalizes unauthorized migrations by the operating companies is justified to the extent that the provider companies go beyond their legal powers. The impact on users translates not only into economic terms but also in time and mistrust in the service, and the actions of regulatory bodies fail to satisfy the claims of users
