This research has the goal to propose an adaptation of the last part of article 21 of the Peruvian civil code which states that ‘when the mother does not reveal the identity of the father, she can register her child with her own two family names’. In the quoted paragraph there is a clear legal gap which declines a father the same right of registering his children with his own two family names when the children have been conceived with a surrogate mother, and when the father as such does not reveal the identity of the surrogate mother. Our conclusion has to be that it is important to adapt article 21 of the Peruvian civil code and as such acknowledge the right for the father to register his children who are born from a surrogate mother with his own two family names in the National Identity Register and the Civil State. It is important to emphasize the importance of imbedding this adaptation of the Peruvian civil legislation in some political, social and scientific changes. As such we should only undertake action if we can guarantee to protect and defend the interest of the children (born from a surrogate mother) as our absolute priority. It is also important to make an adaptation to the 21st article of the civil code and as such recognize the registration of both family names of the father to prevent the violation of equal rights (mother-father), to prevent the violation of the right of identity of a newborn and to prevent the denial of the best interest of the child
