Incorporación de la revocación de la donación por incumplimiento del cargo en el código civil peruano

Abstract

La presente investigación denominada “Incorporación de la revocación de la donación por incumplimiento del cargo en el Código Civil Peruano” tiene por objetivo principal determinar de qué manera el incumplimiento del cargo influye en la revocación de la donación. Asimismo, nos propusimos los siguientes objetivos específicos. Estos son: Determinar de qué manera las implicancias jurídicas de la revocación en el incumplimiento del cargo desde la legislación nacional, analizar la normativa a nivel derecho comparado de la revocación de la donación ante incumplimiento del cargo y proponer la incorporación de la revocación de la donación ante incumplimiento del cargo en el Código Civil peruano. Respecto al enunciado del problema, se plantea la siguiente cuestionante: ¿De qué manera el incumplimiento del cargo influye en la revocación de la donación? Proponiendo como hipótesis que la manera en que el incumplimiento del cargo influye en la revocación de la donación se manifiesta con el traslado del bien donado hacia el patrimonio del donante. Respecto a la metodología se aplicaron los siguientes métodos: doctrinario, hermenéutico-jurídico, exegético, descriptivo- explicativo y analítico-sintético, desde un diseño de investigación no experimental. Asimismo, desde el enfoque cualitativo, se emplearon técnicas e instrumentos que permitieron determinar que el incumplimiento del cargo influye en la revocación de la donación, obteniendo como resultado que, ante el incumplimiento del cargo sobre la revocación de la donación, es necesario su incorporación en el Código Civil peruano.

The present investigation called ““Incorporation of the revocation of the donation for non-compliance of the position in the Peruvian Civil Code““ has as its main objective to determine how the non-compliance of the position influences the revocation of the donation. Likewise, we set ourselves the following specific objectives. These are: Determine how the legal implications of the revocation in breach of office from national legislation, analyze the regulations at a comparative law level of the revocation of the donation in the event of breach of office and propose the incorporation of the revocation of the donation in case of noncompliance with the charge in the Peruvian Civil Code. Regarding the statement of the problem, the following question is raised: How does non-compliance with the position influence the revocation of the donation? Proposing as a hypothesis that the way in which non-compliance with the position influences the revocation of the donation is manifested with the transfer of the donated property to the donor's assets. Regarding the methodology, the following methods were applied: doctrinal, hermeneutical-legal, exegetical, descriptive-explanatory and analytical-synthetic, from a non-experimental research design. Likewise, from the qualitative approach, techniques and instruments were used that made it possible to determine that non-compliance with the charge influences the revocation of the donation, resulting in the fact that, in the event of non-compliance with the charge on the revocation of the donation, it is necessary to incorporate it into the Peruvian Civil Code.
