The purpose of this research study is to analyze a topic that constitutes a crossroads between various fields within the scientific-medical, moral, and legal spheres. The lack of purely legal information that allows establishing in a concrete manner why mandatory vaccination is necessary and providing solid options for it to be voluntary, leads us to deduce that there is a legal issue that needs to be addressed. Initially, the main guidelines of what vaccination is and the current vaccination system in Peru are considered. Then, the conventional framework that regulates vaccines is taken into account, leading to the legal framework that regulates vaccination in Peru. After evaluating the Peruvian norms, it is determined that mandatory vaccination does indeed exist in Peru. Before delving into the legal aspect, the various fields that converge on this topic on a scientific, ecological, and moral level are evaluated in depth, in order to determine in detail whether mandatory vaccination is important or not within our society, noting previous knowledge and essentially its purpose, in such a way that it allows for a sufficient and correct overview of the researched topic. The scientific method will be used as a methodology to analyze the mentioned legal figure, through detailed observation and description, without exerting any influence on such figure through preconceived arguments or ideas. Finally, a confrontation will be established between the treated topics, to subsequently draw legal conclusions and determine whether it essentially affects freedom of conscience or religion, in addition to providing a view of other legal reasons, to finally evaluate international casuistry of failed vaccination.
