It was investigated In what way is the principle of impartiality of the Judge in the accusatory system violated by the application of the ex officio evidence regulated in the Peruvian Criminal Procedure Code? As a working hypothesis, it was considered that ““The principle of impartiality of the judge in the accusatory system is violated with the application of the proof of office regulated in the Peruvian Criminal Procedure, while the observance of the functional separation between the work of investigation and judging acts ““. A sample of 15 criminal proceedings was processed in the Trujillo District Criminal Courts, 2014-2016, chosen at random, to determine whether ex officio evidence was applied. Likewise, 06 criminal judges of Trujillo, 10 jurists specialized in Constitutional Law, Criminal Law and Criminal Procedure were considered; as well as 20 criminal and constitutional lawyers from La Libertad, to obtain their opinions regarding the study variables. To obtain data, the techniques of document content analysis, legislative technique, interview, survey and signing, with their respective instruments were used. The results were organized and presented in frequency tables for further discussion with the analysis, synthesis, inductive and deductive methods. It was concluded that the ex officio proof regulated in the Procedural Code is a backwardness of the inquisitorial model and affects the principles of judicial impartiality and the separation of roles in the criminal process, which support the accusatory system.
