The purpose of the present investigation is to make known the doctrinal foundations, which justify the non-applicability of the nullity of the legal act in the national order. As is known, the nullity of the legal act prescribes ten years as established by article 2001, subsection 1 of the Civil Code, which means that, if the nullity of the legal act is demanded after that term, said process would conclude because the extinctive prescription, however, and in order to prevent the null legal business from creating a situation of appearance in which contracting third parties can be protected in good faith and for consideration, it is “necessary“ to demand the judicial declaration of nullity. Although it is true that the action of nullity is not essential since the act was always null and even, the effects of the sentence that declares it are retroactive; It is not at all idle and superlative to attempt a judicial declaration of nullity, especially in these times where the value of good faith is forgotten, hence the urgent need to obtain a judicial declaration, since it would be very common and above all pernicious that any party acting in a null legal act wants to claim any right derived from that. In conclusion, we consider it necessary that article 2001, paragraph 1 of the Civil Code regarding the prescription of the nullity action of the legal act should be repealed; and, that an article should be included that specifically indicates the nonapplicability of this claim.
