Resumen: La presente tesis se titula “La muerte digna y el principio de libre autodeterminación de la
persona” la cual tuvo el objetivo de determinar si resulta necesario la regulación del derecho
a la muerte digna en el ordenamiento jurídico peruano, para la cual se formuló la pregunta
¿Cuáles son los fundamentos jurídicos que justificarían la regulación del reconocimiento del
derecho a la muerte digna en el ordenamiento peruano?; en base a este contexto la hipótesis
fue: “La regulación del derecho a la muerte digna en el ordenamiento jurídico peruano se
justificaría en los siguientes fundamentos: El caso de ortotanasia un tipo de eutanasia que
consiste en un tratamiento paliativo para el evitar el sufrimiento en enfermos terminales. El
principio de bioética: Autonomía del paciente en enfermos terminales cuyo tratamiento no
responde a su satisfacción ni disminución del dolor. El principio de libre autodeterminación
del paciente debidamente informado sobre los tratamientos médicos que no amortiguan ni
disminuyen la calidad de vida del paciente enfermo terminal”. Se utilizó el método
dogmático y comparativo para analizar los resultados. Asimismo, se utilizó técnica
documental y análisis de contenido con los instrumentos ficha de investigación bibliográfica
y protocolo de análisis de contenido. El resultado fue, que en los países analizados la
regulación del derecho a la muerte digna está basada en la autonomía que tiene el paciente
terminal para tomar la decisión respecto al tratamiento a recibir; en el respeto a la dignidad
de la persona y el acceso a cuidados paliativos. Por lo tanto, la conclusión es que la
regulación del derecho a la muerte digna en el ordenamiento jurídico peruano se puede
fundamentar en el caso de ortotanasia, en donde la muerte puede ocurrir sin miedo, mediante
el uso de cuidados paliativos destinados a aliviar el dolor y brindar comodidad al paciente;
por consiguiente, el derecho a la muerte digna es permitir que la muerte ocurra en el
momento adecuado; para la cual es importante tener en cuenta los principios de bioética en
especial el de autonomía del paciente, para que los médicos respeten la decisiones que tome
el paciente sobre su enfermedad y eviten la obstinación terapéutica, tratándolos como lo que
son (ser humano); aunado a todo esto, está el principio de libre autodeterminación del
paciente, su derecho a decidir si desea o no recibir tratamientos, después de haber sido
debidamente informado sobre los riesgos, complicaciones, consecuencias de un tratamiento.
En consecuencia, no se trata de dejar morir, sino “permitir” que la muerte suceda con el
mínimo de dolor posible, preservando al máximo el derecho a la autodeterminación de la
persona enferma
This thesis is entitled ““The dignified death and the principle of free self-determination of the person““ which had the objective of determining if the regulation of the right to a dignified death in the Peruvian legal system is necessary, for which the question was formulated What are the legal bases that would justify the regulation of the recognition of the right to a dignified death in the Peruvian system ?; Based on this context, the hypothesis was: “The regulation of the right to a dignified death in the Peruvian legal system would be justified on the following grounds: The case of orthothanasia, a type of euthanasia that consists of palliative treatment to avoid suffering in terminally ill. The principle of bioethics: Autonomy of the patient in terminally ill patients whose treatment does not respond to their satisfaction or decrease in pain. The principle of free self-determination of the patient, duly informed about medical treatments that neither dampen nor diminish the quality of life of terminally ill patients”. The dogmatic and comparative method was used to analyze the results. Likewise, a documentary technique and content analysis were used with the bibliographic research sheet instruments and content analysis protocol. The result was that in the countries analyzed the regulation of the right to a dignified death is based on the autonomy that the terminal patient has to make the decision regarding the treatment to be received; in respect for the dignity of the person and access to palliative care. Therefore, the conclusion is that the regulation of the right to a dignified death in the Peruvian legal system can be based on the case of orthothanasia, where death can occur without fear, through the use of palliative care aimed at alleviating pain. and provide patient comfort; Consequently, the right to a dignified death is to allow death to occur at the right time; for which it is important to take into account the principles of bioethics, especially that of patient autonomy, so that doctors respect the decisions that the patient makes about their disease and avoid therapeutic obstinacy, treating them as what they are (human being); In addition to all this, there is the principle of free self-determination of the patient, his right to decide whether or not to receive treatments, after having been duly informed about the risks, complications, consequences of a treatment. Consequently, it is not a question of letting die, but rather ““allowing““ death to happen with the least possible pain, while preserving the sick person's right to self determination as much as possible.
