The present thesis is entitled ““LEGAL MECHANISMS THAT GUARANTEE THE INVIOLABILITY OF THE COMPENSATION OF REMUNERATION IN THE PERUVIAN FINANCIAL SYSTEM““, in which a study was made on the application of bank compensation and the need to establish mechanisms that guarantee its inviolability, according to a systematic interpretation of the civil and banking regulations, complemented with the jurisprudence that develops them. The problem posed in the research is: Is it necessary to determine the legal mechanisms aimed at establishing limits to the power of banks to offset their claims with the remuneration accounts of their clients in Peru? The hypothesis is stated as follows: The legal mechanisms that guarantee the inviolability of compensation to remunerations in the Peruvian financial system is: the unrestricted compliance of the legal precepts regulated in the Peruvian law system in civil and banking matters that are of an imperative nature, promoting a precedent that is binding in the national jurisprudence and thus avoid affecting the right to have a remuneration that safeguards their welfare and that of their family. According to its purpose, the research is applied, according to its scope it is correlational or causal and according to the contrast design it is non-experimental or descriptive. For the elaboration of this study, a data index, bibliographic analysis and interviews to specialists in civil law, banking and related areas were used. Books, magazines and specialized web pages were used to gather information. As a result of the research, a legislative proposal was made to avoid the initiation of administrative and judicial proceedings, thus protecting the intangibility of remunerations
