The thesis that we have called ““THE NECESSARY INCORPORATION OF THE GRADUATION OF MENTAL DAMAGE IN THE CRIMINAL LEGAL ORDER AND THE PRINCIPLE OF REASONABILITY AND PROPORTIONALITY OF PENALTIES““ has the purpose of investigating how it is necessary to incorporate the graduation of mental damage in the legal system criminal law. Regarding the objectives, we proposed, among others: To establish the differences between psychological damage and psychological damage according to doctrine and comparative law, to analyze the criteria for establishing mental injury through the international regulatory framework, to analyze cases where they have been evaluated psychological damage and psychological damage in different crimes, determine legal criteria for the assessment of mental damage under the principle of proportionality and reasonableness of the aggressor, propose the legislative amendment in article 121 -3 and 122 -1 of the Penal Code. In this sense, the problem that we have proposed is the following: WHY IS IT NECESSARY TO INCORPORATE THE GRADUATION OF MENTAL HARM INTO THE CRIMINAL LEGAL ORDER? Faced with this question, we formulate the following research hypothesis
