It is clear that the current bleak outlook after a global pandemic has increased cases of malpractice, medical malpractice, etc. that are covered up with death certificates whose cause of death is presumed death from SARS - coV-19: even today, it becomes a pseudo presumption, iuris et de jure; Therefore, “the prosecution of cases for medical liability has become even more relevant”. Nevertheless; Before this 2020 milestone, many years ago there have been medical practices that, in non-observance of the generic duty not to cause harm, or for the non execution of an obligation, have caused irreversible and irreparable physical or physiological damage, but this should NOT BE UNDERSTOOD AS IRRESARCIBLE. And in this context, our civil code transfers the burden of proof of damage and of the quantum to the victim himself, who not only suffers the PAIN of suffering damage, but who, being in a condition of vulnerability and evidentiary disadvantage, must COMPLY WITH PROVIDE PROOF THAT THE COUNTERPART REALLY HOLDS IT, thus constituting an obstacle to the burden of proof. Consequently, this research will try to describe and provide a solution to this problem, through the proposal of the ““APPLICATION OF NEW CRITERIA OF THE TEST AND THE BURDEN OF THE PROOF, WITH THE PURPOSE OF REDUCING OR IN THE BEST OF CASES AVOID OBSTACULATIONS OF EVIDENCE IN THE PROCESS FOR COMPENSATION OF DAMAGES FOR MEDICAL LIABILITY ”.
