This investigation arises with the publication of Plenary Chamber Resolution No. 001- 2020-SERVIR/TSC by the Civil Service Tribunal, precedent of Mandatory Observance on suspension of the calculation of the limitation periods of the disciplinary regime provided for in the Civil Service Law No. 30057 during the state of emergency; since, by means of a broad interpretation, the Court points out that the rules for the suspension of procedural deadlines that were issued as a result of the state of emergency also suspended the limitation periods of administrative disciplinary proceedings, thus affecting the principle of legality by forgetting that limitation periods can only be modified, resumed or suspended by law. This thesis used the correlational design, which consists of the measurement of two variables to assess their correlation between them, logical and legal methods, research techniques, such as: documentary analysis of doctrine, regulations and jurisprudence, and survey, which were developed through documentary analysis and questionnaire guide. The proposed objectives are related to the results obtained, corroborating and contrasting the hypothesis of this thesis, thus arriving at the most relevant conclusion, which is: The application of Resolution No. 001-2020-SERVIR/TSC, by suspending the limitation periods of the Administrative Disciplinary Procedure of the Civil Service Law No. 30057 based on the rules that were issued during the state of emergency on suspension of procedural deadlines, affected the Principle of Legality; since limitation periods can only be suspended by law.
