The investigation covers the issue related to the regulation of the second paragraph of article 299 of the Penal Code which excludes the exemption from criminal liability for the possession of two or more types of drugs; provision that we consider to contraviate the principle of minimal intervention of criminal law and the provisions of article 8 of our Political Constitution; therefore, the problem was formulated How does the penalty for the minimum possession of two or more types of drugs violate the principle of minimal intervention of criminal law, on the merits of the requirements of Article 299 of the Penal Code? During the execution of the research process we resorted to various methods of scientific research both general and specific; thus through the scientific method, we increase knowledge from existing knowledge and specific or legal methods and techniques and instruments such as documentary collection and interviewing specialists such as Prosecutors and Criminal Lawyers, we have concluded that to the extent that the criminal penalty for the minimum possession of two or more types of drugs is not limited to the indispensable , nor does it include the protection of conduct harmful to legal property in its most dangerous form of attack for them, does not infringe the principle of minimal intervention of criminal law. In addition, from the results obtained and their discussion we conclude that it reinforces our position, as well as validates the legislative proposal that is proposed in order to reduce the number of police interventions to consumers, avoiding the increase in income from consumers to prisons by that subject in accordance with article 2(1) of the same Constitution that configures the fundamental right to free development. Finally, with the conclusions and the legislative proposal proposed, it is proposed to amend article 299 of the Penal Code including within the un punishable possession the possession of drugs for the own immediate consumption, of one or more types, in the minimum amounts established to the exclusion of their scope when possession of two or more types of drugs is for purposes other than own immediate use
