Abstract: La temática elegida se centró en la búsqueda de la protección más
adecuada, dentro de un Estado Constitucional de Derecho, de los
derechos del imputado, dentro de ellos el derecho a la inviolabilidad del
domicilio, dentro de un proceso penal en el que se busca recabar medios
de prueba para un posterior juicio. En ese contexto se realizó la
investigación bajo el tema: “Regulación de la validez del consentimiento
del titular del inmueble, en los casos de allanamiento”.
En relación al tema antes descrito se formuló como problema el
siguiente: “¿De qué manera debe regularse la validez del consentimiento
del titular del inmueble en los casos de allanamiento en el código procesal
penal peruano, en Trujillo- 2021?”, en ese sentido, cabe anotar que como
objetivo general a conseguir es “determinar de qué manera debe
regularse la validez del consentimiento del titular del inmueble en los
casos de allanamiento en el código procesal penal peruano. Teniendo en
cuenta ese propósito de la investigación, se realizó la búsqueda de la
información doctrinaria y producto de ello, se hizo también el análisis a
partir del método hermenéutico de los alcances normativos de esta
medida de restricción de derechos para búsqueda de prueba.
Posteriormente siguiendo la técnica del análisis documental se
analizó lo señalado sobre el tema de investigación, llegándose a
comprobar la hipótesis de que es necesario establecer expresamente
regulación de la presencia del fiscal o del abogado del intervenido para
validar el consentimiento del intervenido al momento que se realice la
diligencia
