Violence against women or one of the members of the family group has been the subject of comment on countless occasions, because in many parts of the world and, specifically, in our country; This type of action is occurring more frequently, which is caused with the purpose of physically, sexually and/or psychologically attacking or other forms of violence against a woman or any of the members of the family group. Given this, the current criminal legislation referring to this subject has had a series of problems that make it difficult to apply article 122°-B of the Penal Code, this formula being classified as vague and imprecise, violating the principle of legality by not being a true and clear law, in the understanding that people denounce various facts considering themselves victims deserving of protection, however, many times these facts have no criminal relevance. Generating with it, frustration in the complainants, waste of time and resources by the Public Ministry. Consequently, through the present investigation it is sought to determine how the current wording of article 122°-B of the Penal Code, referring to aggressions against women and members of the family group, affects the non-formalization and continuation of the preliminary investigation in the prosecutor's office of the limited crime when an assault against ““the woman for her condition as such““ or ““members of the family group““ is reported.
