This investigation originates with the following research question: Does the regulation of the procedural curator, in our current Civil Procedure Code, guarantee the adequate exercise of the right of defense of the absent litigant? Subsequently, the following general objective was raised: Determine whether the regulation of the procedural curator, in our current Civil Procedure Code, guarantees the adequate exercise of the right of defense of the absent litigant. Now, in order to achieve this general objective, the following specific objectives were proposed: 1. Analyze the legal regulation that our Civil Procedure Code carries out regarding the procedural curator; 2. Study the right of defense in the Peruvian civil process and its relationship with the procedural curator; 3. Study the institution of procedural curation in comparative law. Finally, and after having collected the appropriate information and applied the research methods, the following main conclusion was reached: After having carried out an in-depth study, both doctrinal and jurisprudential, of the right to Due Process and the right of Defense, it is possible affirm that the regulation of the procedural curator, in our current Civil Procedure Code, is deficient; Thus, the problem stems from the lack of professionalism of the appointed guardians when representing an absent defendant, since they frequently act by virtue of their appointment without thoroughly examining the circumstances of the case
