Through the present investigation we will focus on studying the judicial possessory defense, which is embodied in article 921 of our civil code. This figure, the date, has a series of problems for its correct execution, since processes processed in parallel are observed, both in civil proceedings (through judicial possessory defense) and in criminal proceedings (regulated as the crime of usurpation) foreseen in article 202 of the penal code. Therefore, we consider it necessary to establish a priority order, by virtue of which we are of the opinion that judicial possessory defenses should be subsumed as new assumptions within the aforementioned article of the penal code. Consequently, with the inclusion of judicial possessory defenses in said criminal type, it is sought to recognize that the protection of possession in the criminal sphere turns out to be much broader, more effective and efficient. In this sense, we seek through this investigation to include the so-called judicial possessory defenses within the delimited crime, to avoid problems of duplicity when raising the usurpation in criminal proceedings, and in parallel, in civil proceedings, an injunction to recover, as well as later in the criminal process, the exception of nature of action.
