Fundamentos jurídicos a favor de la implementación de una Ley de seguro de desempleo en el Perú

Abstract

La Tesis que hemos denominado “Fundamentos Jurídicos a favor de la Implementación de una Ley de Seguro de Desempleo en el Perú”, se orienta a determinar los fundamentos por los cuales la implementación de un Seguro de desempleo beneficiará de forma más adecuada a los trabajadores que la llamada Compensación por Tiempo de Servicios actualmente vigente en nuestro país.

En este sentido, la formulación de nuestro Problema fue el siguiente: ¿de que manera la implementación del seguro de desempleo en el Perú protegerá a los trabajadores de las contingencias del desempleo en el Perú?, frente a lo cual nos planteamos los siguientes objetivos específicos: Investigar las ventajas y diferencias que supone la figura jurídica de la CTS en el Perú y el Seguro de desempleo, en relación a la protección de los trabajadores; Analizar la conveniencia de la implementación de un Seguro de desempleo en sustitución de la Compensación por tiempo de servicios; Conocer las principales cifras evolutivas del desempleo en el Perú, a fin de justificar la implementación de un Seguro de desempleo.

En cuanto al enunciado de la Hipótesis hemos propuesto la siguiente: “La implementación del Seguro de Desempleo en el Perú, protegerá a los trabajadores de las contingencias del desempleo en forma más adecuada que la compensación por tiempo de servicios, al permitir prevenir los efectos originadas por el cese en el trabajo por un lapso mayor de tiempo y gozar de un sistema de Seguridad Social más Integral”.

In this sense, the formulation of our problem was the following: in what way the implementation of unemployment insurance in Peru will protect workers from the contingencies of unemployment in Peru, against which we pose the following specific objectives : Investigate the advantages and differences that the legal figure of the CTS in Peru and the unemployment insurance, in relation to the protection of the workers; Analyze the convenience of implementing an unemployment insurance to replace Compensation for time of service; To know the main evolutionary figures of unemployment in Peru, in order to justify the implementation of unemployment insurance.

Regarding the statement of the Hypothesis we have proposed the following: ““The implementation of the Unemployment Insurance in Peru, will protect workers from unemployment contingencies more adequately than compensation for time of service, by allowing to prevent the originating effects By the cessation of work for a longer period of time and enjoy a more comprehensive social security system. ““
