“This thesis entitled ““The Principle of Legal Certainty in sentencing in the privileged mitigating circumstances the Peruvian Penal Code““; addresses the issue regarding the failure to establish a minimum limit circumstances in the Peruvian Penal Code and its effect to the principle of legal certainty To formulate and contrast our hypothesis, namely that the failure to establish a minimum limit on sentencing in the privileged extenuating circumstances the Peruvian Penal Code would affect the principle of legal certainty, because leaves discretion or judicial discretion the establishment of the specific penalty has been used developed in the Theoretical Framework, themes such as the Theory of grief, Interpretation Law, the Principle of Legality, sentencing Judicial and the principle of legal certainty, has used also, methods, deductive, inductive, synthesis, and analysis of sentences issued by collegiate courts in the Province of Trujillo after the enactment of Law 30076 in which the new rules apply for determining the penalty during the years 2013- 2014 This research has concluded that the failure to establish a minimum limit on sentencing in the privileged mitigating circumstances the Peruvian Penal Code affects the principle of legal certainty because it infringes turn guarantee certa lex, the prohibition of indeterminate laws, and this contributes to leave to the discretion and especially judicial discretion the establishment of the specific penalty, which creates legal uncertainty. “
