This investigation looks that the administrative sanctioning procedure as for transport not transgress the beginning of the administrative general procedure, since the above mentioned beginning is those that stop the legal authority penalty of the public administration. Since there is known the administrative sanctioning procedure, it has period that to expire, and as for transport one governs for a special law, by means of D.S. 016-2009-MTC, modified by the D.S. 003-2014-MTC, in which for inefficiency of the Public Administration, they extended the term to sanction from one to four years, submitting the administered one to a juridical irresolute and permanent situation. Since in transport, there exists a maximum term of incapacitation corresponding to three years, and with the article 338 º of the D.S. 016-2009-MTC amendments, they can be sanctioned even for seven years. Harming the rights and causing hurts to the administered ones, as well as damaging directly the beginning of the due process, in the slope of the reasonable term.
