The purpose of this research is to determine the legal reasons for incorporating the lack of motivation as a basis for annulment of an award in the Peruvian legal system, which is why the theoretical framework necessary to arrive at that basis was divided in three chapters: First chapter, entitled ““The nature of arbitration and the arbitration award““, whose purpose is to explain the nature of arbitration, its jurisdictionality, constitutional incorporation, in addition, to have the necessary concepts about the arbitral award, its classes, form and essential requirements ; Second Chapter, entitled ““The Constitutional Control and The legal Resource of Annulment of Award,““ whose purpose is to recognize the types of constitutional control in arbitration, in addition to relate the annulment resource as a posteriori mechanism of such control; by last, Third Chapter, entitled ““Legal foundations of the incorporation of the lack of motivation as a basis for annulment of Award,““ since, after analyzing the entire theory of the first two chapters, we were able to extract from the constitution and the same arbitration law evidence of the requirement of compliance with the motivation of the awards, and which has not been given as originally planned. It is through these three chapters that it is concluded from the investigation that in the absence of an express cause in the regulations, the right to effective Jurisdictional Tutorship would be restricted, moreover, if those causes are numerus clausus, and if there is an obvious lack of motivation of the arbitration award would be unprotected and violating due process, with due motivation.
