This thesis has been called ““THE RESERVE OF IDENTITY IN THE CRIMINAL PROCEDURAL CODE AND THE RIGHT TO PRESUMPTION IN INNOCENCE AND DEFENSE IN PERU““, and it is oriented to determine if the existence of witnesses with reservation of identity legitimized by the article 248 of the Code of Criminal Procedure, affect the rights of presumption of innocence and defense of the accused, contrary to what is expressly stated in the Constitution. For the investigation carried out, we have analyzed the current problems that are experienced within the criminal process, regarding the reservation of identity of witnesses as a protection measure. As the main regulation, we have the Regulation of the Comprehensive Program for the Protection of Witnesses, Experts, Offenders or Collaborators who intervene in the criminal proceedings, promulgated on February 12, 2010 by Supreme Decree No. 003-2010JUS and the Standard of the Protection Measure contained in our Code of Criminal Procedure. During the process of elaboration of the present work, it was possible to identify very important points responding to our problem, supported by the results obtained. For the realization and analysis of this research were used the scientific and legal methods, which allowed us to develop. In addition, at the conclusion of this paper, it is determined whether the existence of witnesses with reservation of identity, legitimized by article 248 of the Code of Criminal Procedure, affect the rights of presumption of innocence and defense of the accused, contravening those expressly indicated in the Constitution of 1993.
