This thesis has been called “more efficient control mechanisms in the enactment of legislative decrees“. The function that falls directly on Congress the enactment of laws, exceptionally can be delegated to the Executive through legislative decrees on specific matters and for a specified period established in the enabling law, before this, there is the doctrine and comparative law various control mechanisms Legislative Decrees. It is for this reason that the overall objective of the research is to determine the need for more efficient control mechanisms in the enactment of legislative decrees. To meet this objective the different national and foreign doctrine was analyzed as well as their respective legislation, case was selected nationally and judgments of the Constitutional Court; interviews were conducted with experts in constitutional law. The main results of the research were: the Constitutional Court has no uniform constitutional control over legislative decrees criteria and national casuistry presented various arguments on the control of the delegated legislation. On the other hand, comparative law in the case of Chile, Colombia, Bolivia and Spain, using the mechanism of prior judicial review. Regarding the interviews, most indicate that the control mechanisms of the legislative decrees in our country are not efficient. Finally we can conclude that the mechanism of prior judicial review, would make efficient control of legislative decrees, but implementation depends on political factors, we must strengthen the mechanisms for parliamentary scrutiny, since this mechanism does not require Reform the Constitution, but rather modify the Regulation of the Congress, in order to provide greater functionality of the Congress of the Republic.
