Abstract: La presente tesis se ha denominado “Mecanismos de control más eficiente en la dación de los decretos legislativos”. La función que recae directamente en el Congreso de la dación de leyes, excepcionalmente puede ser delegada en el Poder Ejecutivo, mediante decretos legislativos, sobre la materia específica y por el plazo determinado establecidos en la ley autoritativa, ante ello, existe en la doctrina y legislación comparada diversos mecanismos de control de los decretos legislativos. Es por ello, que el objetivo general de la investigación es determinar la necesidad de establecer mecanismos de control más eficientes en la dación de los decretos legislativos. Para cumplir dicho objetivo se analizó la diversa doctrina nacional y extranjera, así como sus respectivas legislaciones, se seleccionó casuística a nivel nacional y sentencias del Tribunal Constitucional; se realizó entrevistas a especialistas en Derecho Constitucional.
Los principales resultados obtenidos en la investigación fueron los siguientes: el Tribunal Constitucional no tiene un criterio uniforme de control constitucional de los decretos legislativos y la casuística nacional presenta diversos argumentos sobre el control de la Legislación Delegada. Por otro lado, la legislación comparada en el caso de Chile, Colombia, Bolivia y España, aplican el mecanismo de control constitucional previo. Respecto a las entrevistas, la mayoría señalan que los mecanismos de control de los decretos legislativos en nuestro país no son eficientes.
Finalmente podemos concluir que, el mecanismo de control constitucional previo, haría eficiente el control de los decretos legislativos, pero su aplicación depende de factores políticos, por lo que debemos fortalecer los mecanismos de control parlamentario, toda vez que este mecanismo no requiere la Reforma de la Constitución Política, sino por el contrario modificar el Reglamento del Congreso, a fin de poder de dotar de mayores funciones al Congreso de la Republica.

It is for this reason that the overall objective of the research is to determine the need for more efficient control mechanisms in the enactment of legislative decrees. To meet this objective the different national and foreign doctrine was analyzed as well as their respective legislation, case was selected nationally and judgments of the Constitutional Court; interviews were conducted with experts in constitutional law. The main results of the research were: the Constitutional Court has no uniform constitutional control over legislative decrees criteria and national casuistry presented various arguments on the control of the delegated legislation. On the other hand, comparative law in the case of Chile, Colombia, Bolivia and Spain, using the mechanism of prior judicial review. Regarding the interviews, most indicate that the control mechanisms of the legislative decrees in our country are not efficient. Finally we can conclude that the mechanism of prior judicial review, would make efficient control of legislative decrees, but implementation depends on political factors, we must strengthen the mechanisms for parliamentary scrutiny, since this mechanism does not require Reform the Constitution, but rather modify the Regulation of the Congress, in order to provide greater functionality of the Congress of the Republic.
