La ampliación de la competencia notarial en la celebración de matrimonio civil

Abstract

El presente trabajo de investigación tiene como propósito, demostrar la necesidad de la ampliación de facultades al notario para celebrar matrimonio civil, ya que permitirá que este acto se realice con fluidez, eficiencia y seguridad, a través de todas las notarías del país, permitiendo que la institución matrimonial tenga mayores índices de formalización y fortalecimiento en nuestro país. Para ello, se han utilizado técnicas como el fichaje y análisis documental; con la finalidad analizar de manera precisa la doctrina, legislación nacional e internacional y práctica jurídica correspondiente a la materia de investigación. El objetivo de esta investigación es determinar, como la ampliación de la competencia notarial en la celebración de matrimonio civil garantiza la promoción del matrimonio en concordancia con el art. 4 de la Constitución Política del Perú, otorgando simplicidad, celeridad procedimental y seguridad jurídica a los contrayentes. Además de plantear una reforma legislativa respecto al tema en desarrollo. Para esto, se ha recurrido a la legislación constitucional, civil y notarial vigente, para efectos de realizar la interpretación de las normas legales, determinando de manera precisa las conclusiones y recomendaciones de la investigación. Con los resultados obtenidos de la presente investigación, se ha podido concluir que; la ampliación de la competencia notarial en la celebración de matrimonio civil garantiza la promoción del matrimonio, otorgando simplicidad, celeridad procedimental y seguridad jurídica a los contrayentes, permitiendo que este acto se realice con fluidez, eficiencia y seguridad jurídica como se viene desarrollando en diferentes países.

For this, it has resorted to constitutional, civil and notary law, for purposes of making the interpretation of legal rules, determining precisely the conclusions and recommendations of the investigation. With the results of this investigation, it has been concluded that; the extension of the notarial competition in celebration of civil marriage ensures the promotion of marriage, providing simplicity, procedural speed and legal certainty to the parties, allowing this act to be done quickly, efficiently and security as is being developed in different countries.
