Talking about an executive process is synonymous to talking about a speedy process, with no substantive discussion about the acquired right but only about the execution and effectiveness of that right. In this context, the foreclosure process seeks the execution of the bona granted as collateral for an unpaid debt, for which the Code of Civil Procedure requires the presentation of the document which contains the guarantee as well as the balance statement Debtor, in order to know the exact amount of the debt settled. Thus, the Sixth Plenary Civil Court has recognized that the executive title in the foreclosure process is constituted by both documents, specifying even the requirements that must contain the debit balance statement attached to the claim and ordering the judge the review of its content. However, it has been omitted to grant a mechanism to the same debtor to speak out about the terms of the debit balance statement attached, restricting the grounds of contradiction to the pronouncement to the document that contains the guarantee. In view of this situation, there is a clear violation of the right of defense of the defendant, since it is prevented from contradicting a document which, as stated above, constitutes part of the executive title that is being collected. Therefore, it is imperative and necessary to regulate a new cause of contradiction that allows the executed to validly exercise their right of defense and with it, to equate the procedural legal relationship.
