Abstract: La presente tesis se va a ocupar de dar una propuesta original a los problemas
de interpretación y aplicación del delito de negociación incompatible previsto en
el artículo 399° del Código Penal. En principio, dicha propuesta versa respecto
de cuál debe ser el objeto de protección específico; se tiene como resultado la
optimización del patrimonio. En seguida, a efectos de darle aplicación a la
misma, se plantea dos aspectos fundamentales, a saber: i) ¿de qué manera se
afecta la optimización del patrimonio?; y, ii) ¿cómo debe probarse? Sobre lo
primero, se concluye que la optimización del patrimonio se lesiona cuando el
funcionario o servidor público actúa sin sujeción a la Ley que regula su accionar
y en resguardo de un provecho propio o de tercero, generando condiciones que
le permitan beneficiarse patrimonialmente. Sobre lo segundo, se recurre a la
prueba indiciaria, pero este tema a su vez nos ha remitido a tener en cuenta los
criterios epistemológicos conforme a la doctrina autorizada.
The present thesis will be proposal for giving an original proposal to the problems of interpretation and application of the crime of incompatible negotiation provided for in article 399° of the Penal Code. In principle, this proposal concerns what should be the subject of specific protection; the result is the optimization of assets. Subsequently, in order to apply it, there are two fundamental aspects, namely: i) what way is the optimization of assets affected? ii) How should it be tested? Regarding the first, it is concluded that the optimization of the patrimony is injured when the civil servant or public servant without subjection to the Law that regulates his actions and in the safeguard of this own or third party benefit, generating conditions that allow him to benefit patrimonially. On the latter, the evidence is used, but this subject in turn has referred us to take into account the epistemological criteria according to the authorized doctrine.
