The present investigation is called ““The right to access to drinking water as a fundamental condition for survival in the Peruvian state““, the recent research was based on the fundamental aspects of the right to water, with the subsequent development of Concepts, definitions by the international community, recognition of this right to access to drinking water as essential for people in international instruments; And how this right has been developed over time, the recognition of the various Courts, implementing regulations, policies, strategies, plans, etc., and the various limitations for the Peruvian State. The general objective is to determine what is necessary to contribute to the effectiveness of the right to potable water, which is a fundamental right implicit in Peru. The research was framed in the type of basic research, grounded and have the purpose of obtaining and collecting information to build a knowledge base that is added to existing information. Descriptive research consists of getting to know the prevailing situations, customs and attitudes through the exact description of activities, objects, processes and people. Documentary research is dedicated to gathering, selecting and analyzing data that are in the form of ““documents““ produced by society to study a particular phenomenon. In the present work a series of techniques and instruments of data collection were also used, specifically the analysis of documentary sources. The Peruvian State has an obligation to guarantee access to drinking water through its public policies and thus contribute to the full provision of the vital liquid for the survival of all people in the State, both urban and rural.
