Inclusión de un seguro ambiental de naturaleza obligatoria en el sector minero

Abstract

La Tesis que hemos denominado “Inclusión de un Seguro Ambiental de naturaleza obligatoria en el sector minero”, se orienta a determinar la necesidad de regular jurídicamente un seguro ambiental de naturaleza obligatoria en el sector minero con el fin de proteger de manera eficaz el ambiente.

En este sentido, la formulación de nuestro Problema fue el siguiente: ¿ES NECESARIO LA INCLUSIÓN DE UN SEGURO AMBIENTAL DE NATURALEZA OBLIGATORIA EN EL SECTOR MINERO CON EL FIN DE PROTEGER DE MANERA EFICAZ EL AMBIENTE?, frente a lo cual nos planteamos los siguientes objetivos específicos: Investigar sobre el marco jurídico internacional y el marco normativo peruano referido a la protección ambiental; Investigar sobre la regulación de los seguros en el país y su viabilidad en materia ambiental; Analizar en el Derecho Comparado la regulación del seguro obligatorio en materia ambiental, y sus implicancias efectivas en la reparación de los daños; Explicar las razones de por qué se debe implementar un seguro ambiental en naturaleza obligatoria en el sector minero en nuestro país. En cuanto al enunciado de la Hipótesis hemos propuesto lo siguiente: “Es necesario regular jurídicamente un seguro ambiental de naturaleza obligatoria en el sector minero con el fin de reparar los daños que se produzcan y servirá como un mecanismo de prevención ante los daños ambientales”.

The thesis we have called ““Inclusion of an Environmental Insurance of a mandatory nature in the mining sector““, is aimed at determining the need to legally regulate environmental insurance of a mandatory nature in the mining sector in order to effectively protect the environment.

In this sense, the formulation of our problem was the following: IS THE INCLUSION OF ENVIRONMENTAL INSURANCE OF A MANDATORY NATURE IN THE MINING SECTOR IN ORDER TO PROTECT EFFECTIVELY THE ENVIRONMENT ?, in view of which we consider the following Specific objectives: To investigate the international legal framework and the Peruvian regulatory framework on environmental protection; Investigate the regulation of insurance in the country and its feasibility in environmental matters; To analyze in the Comparative Law the regulation of compulsory insurance in environmental matters, and its effective implications in the repair of damages; Explain the reasons why it is necessary to implement compulsory environmental insurance in the mining sector in our country.

Regarding the Hypothesis statement we have proposed the following: ““It is necessary to legally regulate environmental insurance of a mandatory nature in the mining sector in order to repair the damages that occur and will serve as a mechanism to prevent environmental damage.““
