Today, he Supreme Court has developed in the Seventh Plenum Civil Casatorio the problems raised by the dissimilar interpretation of the second paragraph of Article 2022 of the Civil Code; notwithstanding resolved, I believe that the rule to be interpreted is not applicable to the case in fact opposed to a real right and annotation of the embargo on the certificate of registration of the property. For this reason it was raised as a problem if does the interpretation of the second paragraph of Article 2022 of the Civil Code has been wrong in the judgment of the Seventh Plenum Civil Casatorio? Also making use of the interpretation of the legislation and interviews with professionals in law came to accept the research hypothesis, reaching the following conclusion: That the decision in the Seventh Plenum Civil Casatorio should be again subject to analysis and systematic interpretation of the rules involved; because judges in charge of issuing the Seventh Plenum Civil Casatorio, have considered only assumption subsumed made in the second paragraph of Article 2022 of the Civil Code on property rights not registered against annotation embargo registration form.
