In our personal relationships, we can see that we invariably find ourselves linked with the so-called material goods or things, which can satisfy our basic or vital needs, as well as interact with others, thus goods help us develop as people . It is in this context of linking subject-matter, the legal system created and developed the so-called real rights, by which is protected with a ““protective mantle““ that links subjectmatter, as this prevents (within the limits and regulations law) that the third parties from interfering in that relationship, thus enabling things meet human needs on one side; and other, which also contribute to personal and social development of their holders.The main real rights are: The property and possession. Both are the main pillars of protection of such a link. In this context, it is possible that whoever is directly related to the thing is not the owner, but the owner (who as we must return to its owner good) and that during the duration of the link; good can be modified by the holder, in such a way that it retains, increase its value or improve the conditions of their possession. In such cases we are confronted with the actual legal form of the improvements, which we believe has not been properly developed both doctrinal level as jurisprudential, which in our current civil code, is regulated between Articles 916 ° to 919 ° ; whenever the reimbursement of the value of improvements must be made by the holder Mediate. Apparently, this scenario appears to be simple and obvious common sense nevertheless involves a great deal of complexity; to the point that the doctrine and jurisprudence have observed serious omissions and contradictions between the substantive rule governing improvements and the procedural rule governing the process to enforce the payment of such reimbursement; both in terms of the deadline, as the opportunity to exercise that right. Consequently, it is adding urgency to emphasize specific reasons that allow us to determine and achieve proper protection to the holder regarding their right to reimbursement, which is why this issue requires a thorough analysis that gives rise to this thesis.
