This research, entitled “PERIODIC REVIEW OF OFFICE OF PRISON PREVENTIVE AND THE RIGHT TO FREEDOM“ incorporating regular automatic review of pretrial detention in Peru's criminal procedural law in safeguarding the right to arise individual freedom, supreme value that includes ensuring the prohibition of arbitrary interference, respecting the presumption of innocence. Preventive detention can not last beyond a reasonable period or beyond the persistence of causal that was invoked to justify it, likewise a constitutional rule of law, the State is obliged to ensure the temporary nature of the measure that can guarantee fundamental constitutional and internationally recognized rights. Through this work, we conducted an analysis of the materials requirements of section 268° to 270° of the New Code of Criminal Procedure, which are required for the survival of pretrial detention. Also, we discuss the incorporation of regular automatic review of pretrial detention as a guarantee of the right to freedom. For this research the type of descriptive applicative research and design cross / correlational research, and the following methods are used: analytical and synthetic, and finally the document analysis technique was applied. In this sense we arrive at the conclusion that the lack of implementation of the periodic review of office of the pretrial detention, as new evidence concurs that determined its imposition violates the right to liberty and the presumption of innocence, the same that as the process of transformation in Latin America, it has been used by the various Latin American countries, adding time limits and reviewing trade.
