This research developed the problems involving the application of Article 425 inc . 3, paragraph b , that is to condemn the acquitted at first instance, the same that was analyzed from two perspectives both domestic and foreign , with the results to various procedural breach both criminal and constitutional principles , for which the problem was formulated : “Determining the legal effect of condemning the acquittal on appeal pursuant to the requirements of paragraph 2 of Article 419 and paragraph 3b of Article 425 of the Criminal Procedure Code“. In developing this thesis, using the scientific method , logical methods , and legal methods was made, along with the techniques and instruments mainly documentary collection and interview various experts on the subject . Results were obtained and discussed our position and asking them to adhere to the non-application of this regulation by its harmful effects and vulneratorios to the above principles. The completion of the research findings have raised and we have dared to raise legislative suggestions in the hope that this will contribute to the improvement of sentencing on appeal following acquittal at first instance.
