Las técnicas de reproducción asistida y la afectación al derecho de filiación en la maternidad subrogada en el Perú

Abstract

El presente trabajo de investigación detenta como objetivo principal analizar los cuestionamientos socio-jurídicos del empleo de las tecnologías de la reproducción asistida, específicamente en el caso de la maternidad subrogada en nuestro ordenamiento jurídico peruano y, a su vez, exponer la ausencia de un marco normativo apropiado para la celebración de este tipo de convenios entre los padres biológicos y la madre subrogada, la ausencia de intervención estatal en los centros médicos que ofrecen este servicio, sin establecer protocolos y lineamientos válidos sin afectar el derecho de filiación de los padres y el interés superior del niño. Asimismo, sustentaremos las principales características de la maternidad subrogada, principales conflictos con derechos inherentes a los grupos familiares, formas de contratación y validez de los referidos acuerdos, exponiendo los beneficios de estos escenarios de cooperación para las parejas infértiles, considerando la carga valorativa de su repercusión en el fenómeno socio-jurídico del nuevo milenio, como la nueva revolución reproductiva. Finalmente, se expondrá un análisis de resultados de entrevistas aplicadas a especialistas de la materia

The main objective of this research work is to analyze the socio-legal questions of the use of assisted reproductive technologies, specifically in the case of surrogate motherhood in our Peruvian legal system and, in turn, to expose the absence of an appropriate regulatory framework for the conclusion of this type of agreements between the biological parents and the surrogate mother, the absence of state intervention in the medical centers that offer this service, without establishing valid protocols and guidelines without affecting the right of filiation of the parents and the best interests of the child. Likewise, we will support the main characteristics of surrogate motherhood, main conflicts with rights inherent to the family groups, forms of contracting and validity of the referred agreements, exposing the benefits of these cooperation scenarios for infertile couples, considering the value load of its repercussion in the socio-legal phenomenon of the new millennium, as the new reproductive revolution. Finally, an analysis of the results of interviews with specialists in the field will be presented.
