Abstract: La investigación tiene como objeto determinar de qué manera la modalidad de
secuestro extorsivo previsto en el artículo 200º acápite sexto del código penal,
resulta innecesaria, por existir la figura del secuestro simple tipificado en el artículo
152º del código penal. El Derecho penal es indispensable, para llevar un control de
los comportamientos reprochables por la comunidad, y su aplicación, debe de ser
legítimo, esto es ser justo, respetando las garantías de la persona, los principios
generales del derecho.
Así mismo el legislador al momento de promulgar una ley, esta debe ser según el
principio de economía legislativa, el cual busca la utilidad y eficacia política de la
norma, tanto en su proceso de gestación como en su resultado.
Ahora la regulación existente de ambas normas superpuestas, ocasiona un conflicto
legal, al momento que el juez tenga que subsumir la conducta, a un tipo penal,
debido a la existencia de una superposición de normas, recurriendo a los principios
del concurso aparente de leyes, para poder solucionar tal conflicto, dilatando así el
proceso, vulnerando derechos inherentes a la persona, tal como la libertad que es
un derecho inherente a la persona humana, el cual se encuentra protegido por cada
constitución política de Estado, y por pactos internacionales, perjudicando a las
partes; es por ello que en mérito al principio de economía legislativa, es necesario
la derogación del secuestro extorsivo, y trasladar el lucro, al delito de secuestro
simple, debido que el secuestro en si consiste en privar la libertad, y siempre se le
ha relacionado con los delitos contra la libertad, y no dentro de los delitos contra el
patrimonio, tal como se encuentra regulado el secuestro extorsivo, en la legislación
comparada.
The purpose of the investigation is to determine how the form of extortive kidnapping provided for in article 200, section six of the penal code, is unnecessary, since there is the figure of simple kidnapping typified in article 152 of the penal code. Criminal law is essential, to control the behavior blameworthy by the community, and its application must be legitimate, that is, be fair, respecting the guarantees of the person, the general principles of law. Likewise, the legislator when promulgating a law, this should be according to the principle of legislative economy, which seeks the political utility and effectiveness of the norm, both in its gestation process and in its result. Now the existing regulation of both superimposed norms, causes a legal conflict, at the moment that the judge has to subsume the conduct, to a criminal type, due to the existence of an overlapping of norms, resorting to the principles of the apparent competition of laws, to be able to solve such conflict, thus delaying the process, violating inherent rights to the person, such as the freedom that is an inherent right to the human person, which is protected by each political constitution of the State, and by international pacts, damaging to the parties; that is why, in merit to the principle of legislative economy, it is necessary to repeal extortive kidnapping, and to transfer profit, to the crime of simple kidnapping, since kidnapping itself consists of depriving liberty, and has always been related to crimes against freedom, and not within crimes against patrimony, as extortive kidnapping is regulated, in comparative legislation.
