The present research work called ““The digitization of employment and the labor rights of delivery men in Peru““ is focused on demonstrating that the digitization of employment, specifically referring to companies framed within the collaborative economy, in the present case the Rappi company affects the labor rights of delivery men in Peru. Therefore, the problem considered is the following: In what way does the digitization of employment affect the labor rights of those distributed on digital platforms in Peru? And it is hypothesized that: “The digitization of employment affects by violating the labor rights of delivery men in Perú. To this end, in order to carry out the analysis of the problem raised, logical methods have been applied, among which the deductive, inductive and analytical method are identified; Likewise, legal methods were used in particular, the dogmatic and comparative method. On the other hand, with regard to the applied data collection techniques, bibliographic and documentary analysis are identified, in that sense instruments such as bibliographic records, use of the Internet, among others, were used. Finally, upon completion of the investigation carried out, the main conclusion was reached that the digitization of employment affects by violating the labor rights of the delivery men in Peru, this due to the fact that the technological transformations that have been taking place, and that find their manifestation more emblematic in the phenomenon of digitization, they are causing profound consequences not only for the economy but also for employment, and as a whole on the current model of labor relations. However, despite recent judicial pronouncements in comparative legislation, there is significant legal uncertainty regarding the qualification of workers at the service of these platforms, legal uncertainty that is used to escape the application of labor regulations, with the consequent reduction in social protection standards, by directly assuming production costs and not being covered by labor regulations and the tutelage of subordinate work. 9 Now, Labor Law faces one of the greatest challenges since its creation; adapt to the new labor realities without losing sight of its essence of worker protection. It must find solutions to the new problems that technology generates, but without causing harm to the nascent technology sector since, without a doubt, it is the future to which we are heading
