Implementación de las salas de consumo supervisado de drogas para los toxicómanos del país

Abstract

El presente trabajo de investigación denominado “Implementación de las salas de consumo supervisado de drogas para los toxicómanos del País”, fundamenta la necesidad y la importancia de implementar las salas de consumo supervisado de drogas, en razón de salvaguardar la salud de los toxicómanos del país, conforme a lo prescrito en la parte in fine del artículo 7 de la Constitución Política del Perú. Por tanto, el enunciado del problema es como sigue: ¿Cuáles son las razones que justifican la implementación de las salas de consumo supervisado de drogas para los toxicómanos del país?, y se tiene como hipótesis formulada, la siguiente: “La adicción a las drogas genera en las personas serios problemas de salud física y mental, es por eso que, teniendo derecho de conformidad con la parte in fine del artículo 7 de la Constitución Política del Perú, a un régimen legal de protección, atención, readaptación y seguridad, objetivos que se alcanzarían con la implementación de las salas de consumo supervisado de drogas en el País”. De esta manera, con el fin de analizar el problema formulado, se utilizaron métodos lógicos, como son el método deductivo, analítico y el sintético. Además, se utilizaron métodos jurídicos, como es el método exegético. Por otra parte, se utilizó el análisis bibliográfico y documental como técnicas de recolección de datos, empleándose para ello con instrumentos como las fichas bibliográficas y el uso de internet. Es asi, que tras haber realizado la investigación, se concluye principalmente en que es necesario implementar las salas de consumo supervisado de drogas en el Perú, a fin de salvaguardar la salud de los toxicómanos del País, de acuerdo a la parte in fine del artículo 7 de la Constitución Política del Perú, porque al no existir un lugar específico para el consumo de drogas, los toxicómanos consumen en la vía pública, sin ningún tipo de higiene, exponiéndose a sufrir muchas enfermedades de gravedad y a sufrir una sobredosis, sin estar cerca del auxilio de un profesional de la salud. Además, al consumir drogas en la calle, se ocasionan problemas de orden público, debido a las conductas delictivas e insalubres que tienen los toxicómanos

The present research work called ““Implementation of supervised drug consumption rooms for drug addicts in the country““, bases the need and the importance of implementing supervised drug consumption rooms, in order to safeguard the health of drug addicts in the country, as prescribed in the final part of article 7 of the Peruvian Constitution. Therefore, the statement of the problem is as follows: ¿What are the reasons that justify the implementation of supervised drug consumption rooms for drug addicts in the country?, and the hypothesis is formulated as follows: ““Drug addiction generates serious physical and mental health problems in individuals, which is why, having the right, in accordance with the final part of article 7 of the Peruvian Constitution, to a legal regime of protection, care, rehabilitation and security, targets that would be achieved with the implementation of supervised drug consumption rooms in the country““. Thus, in order to analyze the problem formulated, logical methods were used, such as the deductive, analytical and synthetic method. In addition, legal methods, such as the exegetic method, were used. In addition, bibliographic and documentary analysis was used as data collection techniques, using tools such as bibliographic sheets and the use of the Internet. Thus, after having conducted the investigation, it is mainly concluded that it is necessary to implement the supervised drug consumption rooms in Peru, in order to safeguard the health of drug addicts in the country, according to the final part of Article 7 of the Constitution of Peru, because in the absence of a specific place for the consumption of drugs, drug addicts consume in the public streets, without any kind of hygiene, being exposed to many serious illnesses and an overdose, without being close to the help of a health professional. In addition, the use of drugs on the streets creates problems of law and order due to the criminal and unhealthy behaviour of drug addicts
