This thesis is entitled: ““The generic regulation of the executive mandate of the obligation to give a sum of money in our civil procedure code and the effective jurisdictional protection““, in this the following question has been raised: ““How does the generic regulation of the executive mandate of obligation to give sum of money violates effective jurisdictional protection?”, formulating as a hypothesis: “the generic regulation of the executive mandate of obligation to give sum of money violates effective jurisdictional protection since it leaves the executor in a state of lack of protection, since, by not regulating a specific term, it would be impossible to establish when the warning of forced execution will materialize.” In the same way, we set ourselves the general objective: ““To make known how it is that the generic regulation of the executive mandate of the obligation to give a sum of money threatens effective jurisdictional protection.““ Arriving at the following general conclusion: ““There is no term for payment compliance in the executive mandate within the executive process of obligation to give sum of money, which entails affirming that there is a serious violation of effective jurisdictional protection every time, that this would not adequately protect creditors who seek to make effective their credit placed for collection; for this reason, it is impossible to establish when the warning of forced execution indicated in the executive order of the aforementioned process will materialize
