The present investigation had as a general objective, to determine the denaturation of the purpose of the trial period in Peru, having established the nullity of dismissal of the worker motivated by pregnancy, birth and its consequences or lactation during the trial period. The research is of a qualitative type, focused on the description and analysis of the foundations for which Law No. 31152 was promulgated. For the present investigation, the inductive, deductive, analytical, synthetic, and hermeneutical method was used; As indicated in the lines above, since it is qualitatively focused, legal dogmatics have been taken into account, and it is carried out under a qualitative approach. In that sense, through the analysis of national and foreign doctrine, together with national jurisprudence, it has been determined that this amendment to subparagraph e) of article 29 of the Single Ordered Text of Legislative Decree No. 728 - Productivity Law and Labor Competitiveness, it does not violate the rights of the employer, it does not contravene the rights of the employer, nor does it violate the constitutionally protected contractual freedom, but on the contrary, it contributes to the improvement of the working conditions of pregnant women, postpartum and in the lactation period, since it provides the necessary protection against a null dismissal, stemming from a discriminatory act. Being exposed, this investigation develops the foundations under which the trial period is not being denatured by the amendment of subsection e) of article 29 of the Labor Productivity and Competitiveness Law, analyzing the current and relevant doctrine and jurisprudence to arrive to the answer to the problem.
