The present thesis is entitled: “Legal nature of the employer's obligation in the attribution of civil liability for work accidents“, which has been oriented to determine the legal nature of the employer's obligation whose non-fulfillment causes a work accident and should be attributed civil liability, it is approached with the qualitative research design of the grounded theory, through which information is obtained from the categories of the phenomenon, as well as the theories that explain it. Likewise, by using the documentary analysis technique and the file technique, by means of the analysis card, bibliographic and summary cards, the hypothesis proposed is accepted. The most outstanding result is that the employer in his capacity as the agent responsible for safety and health at work assumes in some cases an obligation of means and in others an obligation of result, concluding that the legal nature of the employer's obligation must be considered by virtue of the duty of prevention as an obligation of means, requiring him to act with ordinary diligence, whose scope is determined by the type of activity performed and by virtue of the generic duty of not harming, he will respond for the risk created, being an obligation of result.
