Abstract: La presente Tesis abordó la problemática relacionada con la falta de regulación
normativa que permita a los integrantes de las Uniones de Hecho constituir Patrimonio
familiar, institución regulada dentro de la sección de Amparo Familiar en nuestro
código sustantivo civil; no obstante el principio constitucional de protección legal a la
familia y el reconocimiento, también constitucional, de la citada Unión como
institución jurídica, evidenciado un trato diferenciador e incluso hasta discriminatorio.
El trato diferenciador está sustentado en el precepto que las Uniones de Hecho
también conforman una familia entendida como aquella institución natural sobre la
que se sustenta una sociedad y desarrolla la vida de toda nación al estar desterrada en
la actualidad toda posición primigenia y primitiva que la familia era exclusiva del
matrimonio, en ese sentido se formula como enunciado ¿Qué fundamentos jurídicos
sustenta la regulación de la constitución de patrimonio familiar por los integrantes de
las uniones de hecho?
Empleando métodos de investigación tanto generales o lógicos y específicos o
jurídicos, por la naturaleza de la investigación, conjuntamente con las técnicas y sus
respectivos instrumentos se pudo contrastar la hipótesis inicialmente propuesta en el
sentido que la protección constitucional a la familia; el mutuo apoyo moral y material
y, el cuidado de la economía común en la familia que también se instituye con la unión
de hecho, son fundamentos jurídicos para que sus integrantes puedan constituir
Patrimonio familiar de común acuerdo sobre su comunidad de bienes, así como para
que éstos también sean beneficiarios del Patrimonio familiar.
De igual modo, los resultados obtenidos fueron analizados y discutidos recobrando
con mayor fuerza la posición de la investigadora y que motiva la presente en el sentido
que en protección de la familia, sin que ello comprenda discriminación u
diferenciación, a los integrantes de las Uniones de hecho debe reconocérseles el

derecho de instituir Patrimonio familiar de común acuerdo respecto de los bienes
comprendidos que dentro de la comunidad de bienes se produzca y mantenga durante
la vigencia de la referida institución como regular que dichos integrantes también
puedan ser considerados como beneficiarios.
Finalizada la investigación se considera pertinente y relevante arribar a conclusiones y
proponer una recomendación orientada a efectivizar la regulación con la consecuente
modificación legislativa concordante con el proyecto de Ley que también se considera
presentar, en estricta sujeción a la protección legal de la institución natural de la
familia.
This Thesis addressed the problem related to the lack of normative regulation that allows the members of the De Facto Unions to constitute Family Patrimony, an institution regulated within the Family Amparo section in our civil substantive code; notwithstanding the constitutional principle of legal protection of the family and the recognition, also constitutional, of the aforementioned Union as a legal institution, evidenced by a differentiating and even discriminatory treatment.
